    ‘TRAI doesn’t hold the power to order telcos to pay any compensation’; Private Mobile Operators to challenge TRAI order on Compensation for Call Drops

    Private mobile companies has decided to challenge the TRAI order on compensation for call drops which will come into effect from 1st January 2016 onwards. As per the latest media reports, the telecom industry associations – AUSPI (Association of Unified Telecom Service Providers of India) and the COAI (Cellular Operators Association of India) argued that TRAI doesn’t hold the power to order telcos to pay any compensation.

    The regulator is of the view that the mandated regime would provide relief to consumers from the issue of call drops to some extent and spur the service providers to improve quality of service. TRAI will keep a close watch on the implementation of the mandate as well as the measures being initiated by the service providers to minimize the problem of dropped calls and may undertake a review after six months, if necessary.

    “We are very disappointed, we do not believe this is the right solution. There is lot of ambiguity arising from the proposed solutions,” Rajan S Mathews, director general of COAI, said. Mathews said the industry will approach the regulator to seek clarity on various issues, and may even approach TDSAT (Telecom Dispute Settlement and Appellate Tribunal) against TRAI decision.


    These telecom industry associations also blamed closing or unavailability of cell sites as one of the chief reasons for call drops. They added that, the regulations to penalize operators already exists for quality of services and network coverage. Among other things, for a call drop parameter of 2% and prescribe financial disincentives for failing to meet the benchmark, said private telcos in a statement.

    The Telecom Regulatory Authority of India (TRAI) in October said that the Indian mobile operators will have to compensate consumers Re 1 for every call drop that occurs due to fault in their network, which is limited to a maximum of Rs 3 a day per consumer.

      Thank you for your quick response and your reply…
      I came to know that RELIANCE contacted Thiruvalla BSNL (KERALA CIRCLE) AND REQUESTED FOR TOWER SHARING and BSNL. had agreement with Land Lord of this Location and signed agreement for RELIANCE..before two months. But I came to know that from BSNL OFFICE that from RELIANCE COMPANY they have not installed THEIR ANTENNA AND TOO LATE.

      I am from Kerala Pathanamtitta district from Pandalam. There is no coverage for DOCOMO in our area. There is a tower for BSNL near by my house (ULLANOOR FOR BSNL UNDER (Tiruvalla) Ground Based interior Tower and last week IDEA AND RELIANCE has shared with BSNL Tower and Installed). I like to take a connection from DOCOMO and there is no coverage. I came to know that you have tie up agreement with sharing of towers with BSNL and if you can utilize this tower for AIRTEL also then coverage for DOCOMO also we will get…

      NOTE: MY RELATIVES AND FRIENDS COME FOR A VISIT OR STAY THEY ARE NOT GETTING FULL COVERAGE AND GETTING DISCONNECTED WHILE TALKING AND THEY ARE NOT GETTING INTERNET ALSO… AND CALL DROP…

      I have send several mail to IDEA,DOCOMO,RELIANCE, before six months and still not installed.
